Terms of Service and Legal Disclaimers for Morton the Impala LLC

These Terms of Service and Legal Disclaimers ("Agreement") govern your access to and use of the website mortontheimpala.com (the "Site"), operated by Morton the Impala LLC ("Company," "we," "us," or "our"). By accessing the Site, purchasing merchandise, or participating in "Fuel the Build" subscription plans, you agree to be bound by these terms.
1. Fan-Run Tribute Project + Non-Affiliation Disclaimer
Morton the Impala LLC is a fan-run tribute car rebuild project and retail store for fans of the Supernatural vibe. We build and document a tribute vehicle and sell merchandise to help fund that rebuild.
We are not official. Morton the Impala LLC is not affiliated with, associated with, authorized by, endorsed by, or in any way officially connected to:

Warner Bros. Entertainment Inc.;

the "Supernatural" television series, its producers, networks (including The CW Network, LLC), or any related rights holders; or

General Motors, Chevrolet, or any other vehicle manufacturer or brand.
All trademarks, service marks, names, logos, emblems, and images referenced on the Site are the property of their respective owners. Any references to third-party brands or media are for identification, commentary, and tribute purposes only and do not imply sponsorship or endorsement.
2. Content Disclaimer (Entertainment Only — Not Mechanical Advice)
The Site may include blog posts, progress updates, photos, videos, livestreams, parts lists, tool lists, or other technical notes about our rebuild (collectively, "Content"). That Content is provided for entertainment and general informational purposes only.

Not professional advice: We are not providing professional mechanical, engineering, safety, legal, or other advice. Nothing on the Site is a substitute for guidance from a qualified professional.

Do not rely on it as instructions: Do not treat our Content as a service manual or step-by-step repair guide.

3. Merchandise Sales (Orders, Payments, Shipping, Returns)
A. Product availability and pricing
We may limit quantities, discontinue products, and change descriptions or pricing at any time. Prices shown do not include applicable taxes or shipping unless stated.
B. Payments
By providing a payment method, you represent you are authorized to use it. Payments are processed through third-party payment processors, and your payment may be subject to their terms and privacy practices.
C. Shipping
Shipping timelines are estimates only. We are not responsible for delays caused by carriers, weather, customs, or events outside our control.

If international shipping is offered, you are responsible for any duties, taxes, or import fees charged by your country.
D. Returns and refunds (merch)
Merchandise return/refund eligibility (if offered) follows our posted Refund Policy and any instructions provided with your order. If your order arrives damaged, defective, or incorrect, contact us via the Site contact form with your order info so we can help.
4. “Fuel the Build” Subscriptions (Support Plans)
“Fuel the Build” plans are voluntary support/subscription options intended to help fund the tribute build and ongoing content.

Perks may change: Any perks (including behind-the-scenes content) are offered as described at the time you subscribe and may evolve as the project changes.

No ownership or control: Subscriptions do not grant you any ownership, equity, intellectual property rights, or control over the project or the vehicle.
Refunds (subscriptions/support)
To the maximum extent permitted by law, Fuel the Build charges are generally non-refundable, because they function as ongoing support and may include access to digital content/perks. If you believe you were charged in error, contact us via the Site contact form.
5. Intellectual Property (Our Original Stuff)
Unless otherwise stated, the Site and all original content created by Morton the Impala LLC—including our original photos, videos, writing, graphics, logos, and website design—are owned by Morton the Impala LLC and protected by copyright and other applicable laws.
You may not copy, reproduce, distribute, modify, or create derivative works from our original content without our prior written permission.
Nothing in this Agreement grants you any rights in third-party trademarks or copyrighted works referenced on the Site.
6. User Conduct
You agree not to use the Site in a way that is unlawful, harmful, or disruptive. For example, you agree not to:

post or transmit spam, malware, or harmful code;

attempt to gain unauthorized access to the Site or related systems; or

use the Site in a manner that interferes with others’ use and enjoyment.

7. Limitation of Liability (Protecting Ashley + the Project)
To the maximum extent permitted by law:

The Site, Content, merchandise, and subscriptions are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind (express or implied).

Morton the Impala LLC, and our owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Site, Content, merchandise, or subscriptions.

Our total liability for any claim will not exceed the amount you paid to us in the twelve (12) months prior to the event giving rise to the claim (or $100 if you have not paid us), to the extent permitted by law.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Privacy (Contact Form)
If you contact us using the Site contact form, you may provide information such as your name, email address, and message content. We use that information to respond to your request and provide customer support. We do not sell contact-form information. Third-party service providers (such as website hosting, email, payment processors, and shipping providers) may process information on our behalf to provide their services.
9. Governing Law
This Agreement and your use of the Site are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
